House rules

The basic requirements for successful therapy are tranquility and relaxation. Consideration for the well-being of other guests is an important aspect of this. In order to ensure the best possible treatment success for our guests, we ask that you observe the following rules of conduct:

  1. Cell phone use is not permitted anywhere on the property or during excursions and hikes. Cell phone calls are only allowed in your own room with the windows closed.
  2. Please be advised that the Buff Medical Resort has a strict no-smoking and no‑alcohol policy. This policy also applies to e‑cigarettes. Smoking is prohibited throughout the building and on the entire premises. Smoking is permitted only in the designated smoking area.
  3. The smoking and alcohol ban also applies to excursions and hikes.
  4. We kindly request that you refrain from wearing bathrobes in the dining room.
  5. Please wear appropriate swimwear in the pool area.
  6. Face coverings (hijab, niqab, burqa) are not allowed in the Buff Medical Resort.
  7. Please be advised that animals are not permitted on the premises.
  8. We kindly ask for your understanding that WIFI is not available between 10:00 p.m. and 6:30 a.m.
  9. In consideration of our other guests, we kindly request that you observe nighttime rest from 10 p.m. to 6 a.m.
  10. All accompanying persons and visitors of guests must be registered at the reception upon entering the building.

We would like to point out that the house rules apply to all guests of the Buff Medical Resort. Should there be any violations of these rules, the management of the resort is unfortunately entitled to terminate your stay. Please understand that we will not be able to offer a refund in this case.

By booking a stay in our house, you agree to the provisions of these house rules.

General Terms and Conditions

I. Scope

  1. These terms and conditions apply to all contracts of Buff Medical Resort with guests and customers.
  2. Deviating provisions are only valid if expressly acknowledged in writing by Buff Medical Resort.

II. Conclusion of Contract/Minimum Age

  1. A stay without booking a therapy program is not possible.
  2. Visitors and accompanying persons can be accommodated for up to 3 nights without a therapy program, subject to room availability and prior consultation with the management. Please note the current list of prices and services.
  3. The booking becomes legally binding upon sending the reservation confirmation.
  4. Cancellations must be made in writing.
  5. Unused services from a therapy programme will not be reimbursed. Individual elements of the therapy programme cannot be changed.
  6. The minimum age to stay at Buff Medical Resort is 18 years. If accompanied by a parent or guardian, a stay is possible from the age of 16, after prior consultation with the management.

III. Cancellation/Withdrawal

  1. In the event of cancellation of the guest’s stay/booked services, the following cancellation fees shall apply:

  • I:

    Up to 31 days before the date of arrival, 20 % of the costs for booked services stated in the booking confirmation are due.

  • II:

    30 to 14 days before arrival = 50 % of the costs for booked services

  • III:

    13 to 7 days before arrival = 70 % of the costs for booked services

  • IV:

    from the 6th day before arrival = 90 % of the costs for booked services

  • V:

    In the event of early departure during the stay or late arrival, the originally booked services will be charged.

  1. Buff Medical Resort is authorised to terminate the stay in the event of non-compliance with the house rules. There will be no reimbursement of costs for services not provided and originally booked.
  2. Booked individual therapies and offers must be cancelled by the guest by 12.00 noon on the previous day, after which they will be charged. This also applies in the event of non-utilisation.
  3. Meals not utilised will not be refunded.

IV. Services, prices, payments

  1. The written offer includes the total price for the desired arrangement at the Buff Medical Resort. A deposit of 20% is required to accept the offer. The contract is concluded after the deposit has been paid when the Buff Medical Resort sends the reservation confirmation.
  2. The remaining amount for the booked services is due for payment no later than 30 days prior to arrival.
  3. A credit card must be provided as a guarantee on arrival.
  4. The invoice for additionally booked services and goods must be paid before departure.
  5. All services are invoiced in accordance with our currently valid list of prices and services. Earlier tariffs and provisions shall become invalid. We reserve the right to make changes.
  6. Individual contents of our therapy packages cannot be changed or refunded.
  7. The respective therapy package is billed via two invoices. The wellness and sports therapy services are invoiced via Buff Medical Resort GmbH. The medical services are invoiced via Palü Suisse Clinic GmbH. Palü Suisse Clinic GmbH assigns the claim to Buff Medical Resort GmbH for the purpose of collection. The debtor of the claim agrees to the assignment of the claim.

V. Arrival/Departure

  1. The guest receives the booked room category but has no claim to a specific room.
  2. Guests may check in at 3:00 pm on the day of arrival. Should a guest wish to arrive before this time, the Buff Medical Resort reserves the right to charge an additional day’s accommodation fee.
  3. Check-out time is 12:00 noon on the day of departure, otherwise an additional day will be charged.
  4. Guests must present a valid ID/passport and a credit card upon arrival.

VI. Brought Items/Liability

  1. No liability for brought items; use of the in-room safe is recommended.
  2. Use of the underground garage and parking spaces is at the guest’s own risk.
  3. Strict no-smoking and no-alcohol policy throughout the building and premises; smoking is only allowed in designated areas.
    The guest of the respective room is responsible for ensuring that this prohibition is also observed by third parties. A special cleaning fee of €350 will be charged for violations. The same applies if third parties smoke in the room without the guest’s knowledge.

VII. Withdrawal by Buff Medical Resort

  1. Buff Medical Resort may withdraw from the contract for good cause, such as force majeure.
  2. In the event of justified withdrawal, no compensation claims arise for the customer

VIII. Final Provisions

  1. The place of payment and performance is Konstanz.
  2. Jurisdiction is Konstanz.
  3. The law of the Federal Republic of Germany applies.
  4. The invalidity of individual provisions does not affect the validity of the remaining provisions.

The website of the Buff Medical Resort GmbH collects a series of general data and information when a data subject or automated system calls up the website. This general data and information is stored in the server log files. The (1) browser types and versions used, (2) the operating system used by the accessing system, (3) the website from which an accessing system accesses our website (so-called referrer), (4) the sub-websites which are accessed via an accessing system on our website can be recorded, (5) the date and time of access to the website, (6) an internet protocol address (IP address), (7) the internet service provider of the accessing system and (8) other similar data and information used for security purposes in the event of attacks on our information technology systems.

When using these general data and information, the Buff Medical Resort GmbH does not draw any conclusions about the data subject. Rather, this information is needed to (1) deliver the content of our website correctly, (2) optimise the content of our website and the advertising for it, (3) ensure the long-term functionality of our information technology systems and the technology of our website, and (4) provide law enforcement authorities with the information necessary for criminal prosecution in the event of a cyber attack. Therefore, the Buff Medical Resort GmbH analyses anonymously collected data and information statistically, with the aim of increasing the data protection and data security of our enterprise, and to ensure an optimal level of protection for the personal data we process. The anonymous data of the server log files are stored separately from all personal data provided by a data subject.

  1. Registration on our website

The data subject has the option of registering on the controller’s website by providing personal data. Which personal data is transmitted to the controller is determined by the respective input mask used for registration. The personal data entered by the data subject is collected and stored exclusively for internal use by the controller and for its own purposes. The controller may arrange for the transfer to one or more processors, such as a parcel service provider, who will also use the personal data exclusively for internal use attributable to the controller.

By registering on the controller’s website, the IP address assigned by the data subject’s Internet service provider (ISP), the date and time of registration are also stored. This data is stored against the background that this is the only way to prevent the misuse of our services and, if necessary, to make it possible to investigate criminal offences that have been committed. In this respect, the storage of this data is necessary to safeguard the controller. This data will not be passed on to third parties unless there is a legal obligation to pass it on or it serves the purpose of criminal prosecution.

The registration of the data subject with voluntary provision of personal data serves the controller to offer the data subject content or services which, due to the nature of the matter, can only be offered to registered users. Registered persons are free to change the personal data provided during registration at any time or to have it completely deleted from the controller’s database.

The data controller shall provide any data subject with information on which personal data relating to the data subject is stored at any time upon request. Furthermore, the controller shall rectify or erase personal data at the request or indication of the data subject, insofar as this does not conflict with any statutory retention obligations. All of the controller’s employees are available to the data subject as contact persons in this context.

On the website of the Buff Medical Resort GmbH, users are given the opportunity to subscribe to our enterprise’s newsletter. Which personal data is transmitted to the data controller when ordering the newsletter is determined by the input mask used for this purpose.

The Buff Medical Resort GmbH informs its customers and business partners regularly by means of a newsletter about enterprise offers. Our company’s newsletter can only be received by the data subject if (1) the data subject has a valid e-mail address and (2) the data subject registers to receive the newsletter. For legal reasons, a confirmation e-mail will be sent to the e-mail address entered by a data subject for the first time for the newsletter dispatch using the double opt-in procedure. The newsletter of the Buff Medical Resort GmbH contains so-called tracking pixels. If a data subject contacts the data controller by e-mail or via a contact form, the personal data transmitted by the data subject is automatically stored. Such personal data transmitted on a voluntary basis by a data subject to the controller are stored for the purposes of processing or contacting the data subject. This personal data will not be passed on to third parties.

  1. Comment function in the blog on the website

The Buff Medical Resort GmbH offers users the possibility to leave individual comments on individual blog contributions on a blog, which is on the website of the controller. A blog is a portal on a website, usually open to the public, in which one or more people, called bloggers or web bloggers, can post articles or write down thoughts in so-called blog posts. The blog posts can usually be commented on by third parties.

If a data subject leaves a comment in the blog published on this website, information about the time of the comment entry and the user name (pseudonym) chosen by the data subject are stored and published in addition to the comments left by the data subject. The IP address assigned by the data subject’s Internet service provider (ISP) is also logged. The IP address is stored for security reasons and in the event that the person concerned violates the rights of third parties or posts illegal content by posting a comment. The storage of this personal data is therefore in the controller’s own interest so that it can exculpate itself in the event of an infringement. This collected personal data will not be passed on to third parties unless such a transfer is required by law or serves the legal defence of the controller.

  1. Subscription to comments in the blog on the website

The comments made in the blog of the Buff Medical Resort GmbH may be subscribed to by third parties. In particular, it is possible for a commentator to subscribe to the comments following his or her comment on a particular blog post.

If a data subject chooses the option to subscribe to comments, the data controller sends an automatic confirmation email to check in the double opt-in procedure whether the owner of the specified email address has actually opted for this option. The option to subscribe to comments can be cancelled at any time.

  1. Routine erasure and blocking of personal data

The controller shall process and store the personal data of the data subject only for the period necessary to achieve the purpose of storage, or as far as this is granted by the European legislator or other legislators in laws or regulations to which the controller is subject to.

If the storage purpose no longer applies or if a storage period prescribed by the European legislator or another competent legislator expires, the personal data will be routinely blocked or erased in accordance with the statutory provisions.

  1. Rights of the data subject
  • a) Right to confirmation

Each data subject shall have the right granted by the European legislator to obtain from the controller the confirmation as to whether or not personal data concerning him or her are being processed. If a data subject wishes to avail himself of this right of confirmation, he or she may, at any time, contact any employee of the controller.

  • b) Right to information

Any person affected by the processing of personal data has the right granted by the European legislator of directives and regulations to obtain from the controller free information about the personal data stored about him/her and a copy of this information at any time. Furthermore, the European legislator has granted the data subject access to the following information:

  • the purposes of processing
  • the categories of personal data that are processed
  • the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations
  • where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period
  • the existence of the right to request from the controller rectification or erasure of personal data or restriction of processing of personal data concerning the data subject or to object to such processing
  • the existence of a right to lodge a complaint with a supervisory authority
  • if the personal data is not collected from the data subject: All available information about the origin of the data
  • the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) GDPR and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject

Furthermore, the data subject has a right to information as to whether personal data has been transferred to a third country or to an international organisation. If this is the case, the data subject also has the right to obtain information about the appropriate safeguards in connection with the transfer.

If a data subject wishes to avail himself of this right of access, he or she may, at any time, contact any employee of the controller.

  • c) Right to rectification

Any person affected by the processing of personal data has the right granted by the European legislator of directives and regulations to demand the immediate correction of incorrect personal data concerning them. Furthermore, the data subject has the right to request the completion of incomplete personal data, including by means of a supplementary declaration, taking into account the purposes of the processing.

If a data subject wishes to exercise this right to rectification, he or she may, at any time, contact any employee of the controller.

  • d) Right to erasure (right to be forgotten)

Each data subject shall have the right granted by the European legislator to obtain from the controller the erasure of personal data concerning him or her without undue delay, and the controller shall have the obligation to erase personal data without undue delay where one of the following grounds applies, as long as the processing is not necessary

  • The personal data was collected or otherwise processed for purposes for which it is no longer necessary.
  • The data subject withdraws the consent on which the processing is based according to Art. 6 para. 1 letter a GDPR or Art. 9 para. 2(a) GDPR and there is no other legal basis for the processing.
  • The data subject shall, in accordance with Art. 21 para. 1 GDPR and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Art. 21 (1) GDPR. 2 GDPR to object to the processing.
  • The personal data was processed unlawfully.
  • The deletion of personal data is necessary to fulfil a legal obligation under Union law or the law of the Member States to which the controller is subject.
  • The personal data have been collected in relation to the offer of information society services referred to in Art. 8 (1) GDPR. 1 DS-GVO collected.

If one of the aforementioned reasons applies, and a data subject wishes to request the erasure of personal data stored by the Buff Medical Resort GmbH, he or she may, at any time, contact any employee of the controller. An employee of Buff Medical Resort GmbH shall promptly ensure that the erasure request is complied with immediately.

If the personal data have been made public by the Buff Medical Resort GmbH and our company is responsible pursuant to Art. 17 para. Where the Buff Medical Resort GmbH has made the personal data public and is obliged pursuant to Article 1 of the GDPR to erase the personal data, the Buff Medical Resort GmbH, taking account of available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform other controllers processing the personal data that the data subject has requested erasure by such controllers of any links to, or copy or replication of, those personal data, as far as processing is not required. An employees of the Buff Medical Resort GmbH will arrange the necessary measures in individual cases.

  • e) Right to restriction of processing

Each data subject shall have the right granted by the European legislator to obtain from the controller restriction of processing where one of the following applies:

  • The accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data.
  • The processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead.
  • The controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims.
  • The data subject has objected to processing pursuant to Art. Art. 21 para. 1 GDPR and it is not yet clear whether the legitimate grounds of the controller override those of the data subject.

If one of the aforementioned conditions is met, and a data subject wishes to request the restriction of the processing of personal data stored by the Buff Medical Resort GmbH, he or she may at any time contact any employee of the controller. The employee of the Buff Medical Resort GmbH will arrange the restriction of the processing.

  • f) Right to data portability

Each data subject shall have the right granted by the European legislator to receive the personal data concerning him or her, which he or she has provided to a controller, in a structured, commonly used and machine-readable format. You also have the right to transmit this data to another controller without hindrance from the controller to which the personal data has been provided, where the processing is based on consent pursuant to Art. 6 (1) GDPR. 1 letter a GDPR or Art. 9 para. 2 letter a DS-GVO or on a contract pursuant to Art. 6 para. 1 (b) GDPR and the processing is carried out by automated means, unless the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

Furthermore, in exercising his or her right to data portability pursuant to Art. 20 para. 1 GDPR, the data subject shall have the right to have the personal data transmitted directly from one controller to another, where technically feasible and when doing so does not adversely affect the rights and freedoms of others.

In order to assert the right to data portability, the data subject may at any time contact any employee of the Buff Medical Resort GmbH.

  • g) Right to object

Each data subject shall have the right granted by the European legislator to object, on grounds relating to his or her particular situation, at any time, to processing of personal data concerning him or her, which is based on Article 6(1) of the GDPR, including profiling based on those provisions. 1 (e) or (f) of the GDPR. This also applies to profiling based on these provisions.

The Buff Medical Resort GmbH shall no longer process the personal data in the event of the objection, unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or for the establishment, exercise or defence of legal claims.

If the Buff Medical Resort GmbH processes personal data for direct marketing purposes, the data subject shall have the right to object at any time to processing of personal data concerning him or her for such marketing. This also applies to profiling insofar as it is associated with such direct advertising. If the data subject objects to the Buff Medical Resort GmbH to the processing for direct marketing purposes, the Buff Medical Resort GmbH will no longer process the personal data for these purposes.

In addition, the data subject has the right, on grounds relating to his or her particular situation, to object to processing of personal data concerning him or her by the Buff Medical Resort GmbH for scientific or historical research purposes, or for statistical purposes pursuant to Article 89(1) of the GDPR. 1 GDPR, unless the processing is necessary for the performance of a task carried out for reasons of public interest.

In order to exercise the right to object, the data subject may contact any employee of the Buff Medical Resort GmbH. The data subject is also free, in the context of the use of information society services and notwithstanding Directive 2002/58/EC, to exercise his or her right to object by automated means using technical specifications.

  • h) Automated decisions in individual cases including profiling

Each data subject shall have the right granted by the European legislator not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her, or similarly significantly affects him or her, provided that the decision (1) is not necessary for the conclusion or performance of a contract between the data subject and the controller, or (2) is authorised by Union or Member State law to which the controller is subject and which also lays down suitable measures to safeguard the data subject’s rights and freedoms and legitimate interests, or (3) is based on the data subject’s explicit consent.

If the decision (1) is necessary for entering into, or the performance of, a contract between the data subject and a data controller, or (2) it is based on the data subject’s explicit consent, the Buff Medical Resort GmbH shall implement suitable measures to safeguard the data subject’s rights and freedoms and legitimate interests, at least the right to obtain human intervention on the part of the controller, to express his or her point of view and contest the decision.

If the data subject wishes to exercise the rights concerning automated individual decision-making, he or she may, at any time, contact any employee of the controller.

  • i) Right to withdraw consent under data protection law

Any person affected by the processing of personal data has the right granted by the European legislator to withdraw consent to the processing of personal data at any time.

If the data subject wishes to exercise the right to withdraw the consent, he or she may, at any time, contact any employee of the controller.

  1. Data protection for applications and in the application process

The data controller collects and processes the personal data of applicants for the purpose of handling the application process. Processing can also be carried out electronically. This is particularly the case if an applicant submits relevant application documents to the controller by electronic means, for example by e-mail or via a web form on the website. If the data controller concludes an employment contract with an applicant, the data transmitted will be stored for the purpose of processing the employment relationship in compliance with the statutory provisions. If the data controller does not conclude an employment contract with the applicant, the application documents will be automatically deleted two months after notification of the rejection decision, provided that no other legitimate interests of the data controller stand in the way of deletion.   1. Legal basis of the processing

Art. 6 I lit. a GDPR serves our company as the legal basis for processing operations for which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is party, as is the case, for example, when processing operations are necessary for the supply of goods or to provide any other service or consideration, the processing is based on Article 6 I lit. b GDPR. The same applies to such processing operations that are necessary for the implementation of pre-contractual measures, for example in cases of enquiries about our products or services. If our company is subject to a legal obligation which requires the processing of personal data, such as for the fulfilment of tax obligations, the processing is based on Art. 6 I lit. f GDPR. c GDPR. In rare cases, the processing of personal data may be necessary to protect the vital interests of the data subject or another natural person. This would be the case, for example, if a visitor were injured in our company and their name, age, health insurance details or other vital information had to be passed on to a doctor, hospital or other third party.   • the existence of a right to lodge a complaint with a supervisory authority
  • if the personal data is not collected from the data subject: All available information about the origin of the data
  • the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) GDPR and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject

  • The deletion of personal data is necessary to fulfil a legal obligation under Union law or the law of the Member States to which the controller is subject.
  • The personal data have been collected in relation to the offer of information society services referred to in Art. 8 (1) GDPR. 1 DS-GVO collected.

If one of the aforementioned reasons applies, and a data subject wishes to request the erasure of personal data stored by the Buff Medical Resort GmbH, he or she may, at any time, contact any employee of the controller. An employee of Buff Medical Resort GmbH shall promptly ensure that the erasure request is complied with immediately.

If the personal data have been made public by the Buff Medical Resort GmbH and our company is responsible pursuant to Art. 17 para. Where the Buff Medical Resort GmbH has made the personal data public and is obliged pursuant to Article 1 of the GDPR to erase the personal data, the Buff Medical Resort GmbH, taking account of available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform other controllers processing the personal data that the data subject has requested erasure by such controllers of any links to, or copy or replication of, those personal data, as far as processing is not required.   • e) Right to restriction of processing

Each data subject shall have the right granted by the European legislator to obtain from the controller restriction of processing where one of the following applies:

  • The accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data.
  • The processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead.
  • The controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims.
  • The data subject has objected to processing pursuant to Art. Art. 21 para. 1 GDPR and it is not yet clear whether the legitimate grounds of the controller override those of the data subject.

If one of the aforementioned conditions is met, and a data subject wishes to request the restriction of the processing of personal data stored by the Buff Medical Resort GmbH, he or she may at any time contact any employee of the controller. The employee of the Buff Medical Resort GmbH will arrange the restriction of the processing.

  • f) Right to data portability

Each data subject shall have the right granted by the European legislator to receive the personal data concerning him or her, which he or she has provided to a controller, in a structured, commonly used and machine-readable format. In order to assert the right to data portability, the data subject may at any time contact any employee of the Buff Medical Resort GmbH.

  • g) Right to object

Each data subject shall have the right granted by the European legislator to object, on grounds relating to his or her particular situation, at any time, to processing of personal data concerning him or her, which is based on Article 6(1) of the GDPR, including profiling based on those provisions. 1 (e) or (f) of the GDPR. This also applies to profiling based on these provisions.

The Buff Medical Resort GmbH shall no longer process the personal data in the event of the objection, unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or for the establishment, exercise or defence of legal claims.

If the Buff Medical Resort GmbH processes personal data for direct marketing purposes, the data subject shall have the right to object at any time to processing of personal data concerning him or her for such marketing. This also applies to profiling insofar as it is associated with such direct advertising.   • i) Right to withdraw consent under data protection law

Any person affected by the processing of personal data has the right granted by the European legislator to withdraw consent to the processing of personal data at any time.

  1. Data protection for applications and in the application process

The data controller collects and processes the personal data of applicants for the purpose of handling the application process. Processing can also be carried out electronically. This is particularly the case if an applicant submits relevant application documents to the controller by electronic means, for example by e-mail or via a web form on the website. If the data controller concludes an employment contract with an applicant, the data transmitted will be stored for the purpose of processing the employment relationship in compliance with the statutory provisions.
