House rules

The basic requirements for successful therapy are tranquility and relaxation. Consideration for the well-being of other guests is an important aspect of this. In order to ensure the best possible treatment success for our guests, we ask that you observe the following rules of conduct:

Cell phone use is not permitted anywhere on the property or during excursions and hikes. Cell phone calls are only allowed in your own room with the windows closed.
Please be advised that the Buff Medical Resort has a strict no-smoking and no‑alcohol policy. This policy also applies to e‑cigarettes. Smoking is prohibited throughout the building and on the entire premises. Smoking is permitted only in the designated smoking area.
The smoking and alcohol ban also applies to excursions and hikes.
We kindly request that you refrain from wearing bathrobes in the dining room.
Please wear appropriate swimwear in the pool area.
Face coverings (hijab, niqab, burqa) are not allowed in the Buff Medical Resort.
Please be advised that animals are not permitted on the premises.
We kindly ask for your understanding that WIFI is not available between 10:00 p.m. and 6:30 a.m.
In consideration of our other guests, we kindly request that you observe nighttime rest from 10 p.m. to 6 a.m.
All accompanying persons and visitors of guests must be registered at the reception upon entering the building.

We would like to point out that the house rules apply to all guests of the Buff Medical Resort. Should there be any violations of these rules, the management of the resort is unfortunately entitled to terminate your stay. Please understand that we will not be able to offer a refund in this case.

General Terms and Conditions

I. Scope

These terms and conditions apply to all contracts of Buff Medical Resort with guests and customers.
Deviating provisions are only valid if expressly acknowledged in writing by Buff Medical Resort.

II. Conclusion of Contract/Minimum Age

A stay without booking a therapy program is not possible.
Visitors and accompanying persons can be accommodated for up to 3 nights without a therapy program, subject to room availability and prior consultation with the management. Please note the current list of prices and services.
The booking becomes legally binding upon sending the reservation confirmation.
Cancellations must be made in writing.
Unused services from a therapy programme will not be reimbursed. Individual elements of the therapy programme cannot be changed.
The minimum age to stay at Buff Medical Resort is 18 years. If accompanied by a parent or guardian, a stay is possible from the age of 16, after prior consultation with the management.

III. Cancellation/Withdrawal

In the event of cancellation of the guest’s stay/booked services, the following cancellation fees shall apply:

I:

Up to 31 days before the date of arrival, 20 % of the costs for booked services stated in the booking confirmation are due.
II:

30 to 14 days before arrival = 50 % of the costs for booked services
III:

13 to 7 days before arrival = 70 % of the costs for booked services
IV:

from the 6th day before arrival = 90 % of the costs for booked services
V:

In the event of early departure during the stay or late arrival, the originally booked services will be charged.

Buff Medical Resort is authorised to terminate the stay in the event of non-compliance with the house rules. There will be no reimbursement of costs for services not provided and originally booked.
Booked individual therapies and offers must be cancelled by the guest by 12.00 noon on the previous day, after which they will be charged. This also applies in the event of non-utilisation.
Meals not utilised will not be refunded.

IV. Services, prices, payments

The written offer includes the total price for the desired arrangement at the Buff Medical Resort. A deposit of 20% is required to accept the offer. The contract is concluded after the deposit has been paid when the Buff Medical Resort sends the reservation confirmation.
The remaining amount for the booked services is due for payment no later than 30 days prior to arrival.
A credit card must be provided as a guarantee on arrival.
The invoice for additionally booked services and goods must be paid before departure.
All services are invoiced in accordance with our currently valid list of prices and services. Earlier tariffs and provisions shall become invalid. We reserve the right to make changes.
Individual contents of our therapy packages cannot be changed or refunded.
The respective therapy package is billed via two invoices. The wellness and sports therapy services are invoiced via Buff Medical Resort GmbH. The medical services are invoiced via Palü Suisse Clinic GmbH. Palü Suisse Clinic GmbH assigns the claim to Buff Medical Resort GmbH for the purpose of collection. The debtor of the claim agrees to the assignment of the claim.

V. Arrival/Departure

The guest receives the booked room category but has no claim to a specific room.
Guests may check in at 3:00 pm on the day of arrival. Should a guest wish to arrive before this time, the Buff Medical Resort reserves the right to charge an additional day’s accommodation fee.
Check-out time is 12:00 noon on the day of departure, otherwise an additional day will be charged.
Guests must present a valid ID/passport and a credit card upon arrival.

VI. Brought Items/Liability

No liability for brought items; use of the in-room safe is recommended.
Use of the underground garage and parking spaces is at the guest’s own risk.
Strict no-smoking and no-alcohol policy throughout the building and premises; smoking is only allowed in designated areas.
The guest of the respective room is responsible for ensuring that this prohibition is also observed by third parties. A special cleaning fee of €350 will be charged for violations. The same applies if third parties smoke in the room without the guest’s knowledge.

VII. Withdrawal by Buff Medical Resort

Buff Medical Resort may withdraw from the contract for good cause, such as force majeure.
In the event of justified withdrawal, no compensation claims arise for the customer

VIII. Final Provisions

The place of payment and performance is Konstanz.
Jurisdiction is Konstanz.
The law of the Federal Republic of Germany applies.
The invalidity of individual provisions does not affect the validity of the remaining provisions.

The Buff Medical Resort GmbH informs its customers and business partners regularly by means of a newsletter about enterprise offers. Routine erasure and blocking of personal data

b) Right to information

Any person affected by the processing of personal data has the right granted by the European legislator of directives and regulations to obtain from the controller free information about the personal data stored about him/her and a copy of this information at any time. Furthermore, the European legislator has granted the data subject access to the following information:

the categories of personal data that are processed
the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations
where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period

The deletion of personal data is necessary to fulfil a legal obligation under Union law or the law of the Member States to which the controller is subject.
The personal data have been collected in relation to the offer of information society services referred to in Art. 8 (1) GDPR. 1 DS-GVO collected.

If one of the aforementioned reasons applies, and a data subject wishes to request the erasure of personal data stored by the Buff Medical Resort GmbH, he or she may, at any time, contact any employee of the controller. An employee of Buff Medical Resort GmbH shall promptly ensure that the erasure request is complied with immediately.

If the personal data have been made public by the Buff Medical Resort GmbH and our company is responsible pursuant to Art. 17 para. Where the Buff Medical Resort GmbH has made the personal data public and is obliged pursuant to Article 1 of the GDPR to erase the personal data, the Buff Medical Resort GmbH, taking account of available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform other controllers processing the personal data that the data subject has requested erasure by such controllers of any links to, or copy or replication of, those personal data, as far as processing is not required. e) Right to restriction of processing

Each data subject shall have the right granted by the European legislator to obtain from the controller restriction of processing where one of the following applies:

The accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data.
The processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead.
The controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims.
The data subject has objected to processing pursuant to Art. Art. 21 para. 1 GDPR and it is not yet clear whether the legitimate grounds of the controller override those of the data subject.

If one of the aforementioned conditions is met, and a data subject wishes to request the restriction of the processing of personal data stored by the Buff Medical Resort GmbH, he or she may at any time contact any employee of the controller. The employee of the Buff Medical Resort GmbH will arrange the restriction of the processing.

f) Right to data portability

Each data subject shall have the right granted by the European legislator to receive the personal data concerning him or her, which he or she has provided to a controller, in a structured, commonly used and machine-readable format. Furthermore, in exercising his or her right to data portability pursuant to Art. 20 para. 1 GDPR, the data subject shall have the right to have the personal data transmitted directly from one controller to another, where technically feasible and when doing so does not adversely affect the rights and freedoms of others.

In order to assert the right to data portability, the data subject may at any time contact any employee of the Buff Medical Resort GmbH.

g) Right to object

Each data subject shall have the right granted by the European legislator to object, on grounds relating to his or her particular situation, at any time, to processing of personal data concerning him or her, which is based on Article 6(1) of the GDPR, including profiling based on those provisions. 1 (e) or (f) of the GDPR. This also applies to profiling based on these provisions.

The Buff Medical Resort GmbH shall no longer process the personal data in the event of the objection, unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or for the establishment, exercise or defence of legal claims.

If the Buff Medical Resort GmbH processes personal data for direct marketing purposes, the data subject shall have the right to object at any time to processing of personal data concerning him or her for such marketing. This also applies to profiling insofar as it is associated with such direct advertising. If the decision (1) is necessary for entering into, or the performance of, a contract between the data subject and a data controller, or (2) it is based on the data subject’s explicit consent, the Buff Medical Resort GmbH shall implement suitable measures to safeguard the data subject’s rights and freedoms and legitimate interests, at least the right to obtain human intervention on the part of the controller, to express his or her point of view and contest the decision.

If the data subject wishes to exercise the rights concerning automated individual decision-making, he or she may, at any time, contact any employee of the controller.

i) Right to withdraw consent under data protection law

Any person affected by the processing of personal data has the right granted by the European legislator to withdraw consent to the processing of personal data at any time.

Data protection for applications and in the application process

The data controller collects and processes the personal data of applicants for the purpose of handling the application process. Processing can also be carried out electronically. This is particularly the case if an applicant submits relevant application documents to the controller by electronic means, for example by e-mail or via a web form on the website.
